Dear user of ThermFox (hereinafter referred to as "the App"), thank you for using the App provided by ThermFox (hereinafter referred to as "we"). Our App is designed to assist our thermal imaging devices (hereinafter referred to as "the Products").

Respecting and protecting your privacy is one of our fundamental principles. This Policy details how we collect, use, and store your personal data in accordance with the EU General Data Protection Regulation (GDPR).

2. Data We Process, Legal Basis and Purpose

We only process your personal data for explicit, specific purposes and strictly in accordance with the legal bases stipulated by the GDPR. The following is a detailed description of our processing activities:

2.1 Accessing Device Storage

Data Categories Concerned: Photos and videos generated within the App.

Purpose: To save images and videos generated by the App locally; to browse and manage saved media files within the App.

Legal Basis: Performance of Contract (GDPR Art. 6(1)(b))

2.2 Communication with the Scope Device

Data Categories Concerned: Scope device information (including video stream), thermal photo/video files, and certain configuration data.

Purpose: Firmware updates for the scope; controlling certain operations of the scope; obtaining thermal photo/video files stored in the scope; real-time monitoring of the scope's thermal imaging feed.

Legal Basis: Performance of Contract (GDPR Art. 6(1)(b)) (Necessary for the core interconnected functionality of the product)

2.3 Connecting to Cloud Servers

Data Categories Concerned: Partial scope device information, certain App-internal databases, firmware packages for scope upgrades, App error logs.

Purpose: To check for and download new firmware packages for the scope; to obtain updated databases; to collect App error and exception information for future user experience improvements.

Legal Basis: Performance of Contract (GDPR Art. 6(1)(b)) & Legitimate Interests (GDPR Art. 6(1)(f))

2.4 Accessing Device Camera

Data Categories Concerned: Video stream from the device camera.

Purpose: For the scanning function within the App (scanning only, does not generate or save any photo or video files).

Legal Basis: Performance of Contract (GDPR Art. 6(1)(b))

Explanation of Legal Bases:

·Performance of Contract (GDPR Art. 6(1)(b)): All the aforementioned processing activities are strictly necessary to provide you with the core service of interconnecting the ThermFox App with the device. If you do not agree to the processing of this data, we will be unable to provide you with the basic functionalities of the product.

·Legitimate Interests (GDPR Art. 6(1)(f)): Non-core data processing within cloud service connections for maintaining service security, stability, and improvement (e.g., analyzing crash reports to fix bugs) is based on this basis. You have the right to object to this processing.

·Data Minimization: We only collect and process the minimum data necessary to achieve the purposes stated above. For example, when accessing the camera, we only process the real-time image stream to complete scanning and obtain related configuration data, and do not store any image files. When communicating with the device, we only transmit operational commands and necessary configuration data.

·For processing based on consent, you may withdraw your consent at any time in the App settings. For processing based on legitimate interests, you have the right to object.

3. Your Data Subject Rights

Under the GDPR, you have the following rights:

·Right of access, rectification, erasure (‘right to be forgotten’)

·Right to restriction of processing, data portability

·Right to object, and rights in relation to automated decision-making

·Right to withdraw your consent at any time

·Right to lodge a complaint with a supervisory authority in your Member State.

We retain your personal data only for as long as necessary for the purposes stated in this policy, or for a longer period if required to comply with legal obligations (e.g., tax laws).
